These Terms of Service (“Terms”) are an agreement between you and Los Angeles SEO Inc., a California corporation doing business as Bloomize (“Bloomize”, “we”, “us”). They apply to bloomize.com, app.bloomize.com, our reports and emails, and any related services (together, the “Service”). By creating an account, starting a trial or using the Service, you agree to these Terms. If you use the Service for a business, you confirm you are authorized to accept these Terms for that business, and “you” includes that business.
Please also read our Privacy Policy, Refund and Cancellation Policy, Acceptable Use Policy and, for business customers, our Data Processing Addendum. They are part of these Terms.
Bloomize is an online dashboard that reads data from accounts you choose to connect (such as Google Search Console, Google Analytics, Google Business Profile, Google Ads and Constant Contact) and from public sources, and shows it in reports with plain-language explanations. Features differ by plan and are described on our pricing page. We may improve, change or remove features over time. If we remove a core feature of your paid plan, we will tell you in advance.
Reports, suggestions and tips are general information to help you understand your marketing. They are not legal, financial or professional advice, and we do not guarantee any particular ranking, traffic, review or sales result. Search engines, AI assistants and other third parties control their own results and can change them at any time.
New accounts can try Bloomize free for 14 days. To start the trial you choose a plan and add a payment card. We email you a reminder at least 3 days before the trial ends. When the trial ends, your plan starts automatically and your card is charged the price shown at checkout, then every month or year until you cancel. Cancel any time before the trial ends and you will not be charged. We may limit trials to one per business and end trials that are used to abuse the Service.
Automatic renewal. Paid plans are subscriptions that renew automatically at the end of each billing period (monthly or yearly, as you choose) and are charged to your payment method at the price shown at checkout, plus any applicable tax, until you cancel. Before you subscribe, we show you the plan, price, billing period and how to cancel, and we ask you to agree. After you subscribe, we email you a confirmation with these details and how to cancel.
You can cancel at any time, online, without contacting us: in the app go to Account → Manage billing → Cancel plan. You can also email [email protected] and we will cancel for you. Cancellation takes effect at the end of your current billing period; you keep access until then and you will not be charged again. Details are in our Refund and Cancellation Policy.
Because you can try Bloomize free before paying, payments are non-refundable and we do not give refunds or credits for partial billing periods, unused time or unused features, except where required by law or where we state otherwise in writing. If we charge you in error, we will refund the incorrect amount. See the Refund and Cancellation Policy.
If you use Bloomize to serve your own clients, you are responsible for your relationship with them, for having their permission to connect and view their accounts, and for any reports you send them. Your clients’ use of the Service under your account is subject to these Terms, and you must not make promises to them on our behalf. White-label features let you show your own logo and domain; you must have the right to use those marks.
You agree to follow our Acceptable Use Policy. In short: no illegal activity, no accessing data you are not authorized to see, no attempts to break, overload, copy or reverse-engineer the Service, and no reselling it without our written permission (other than the agency plan).
The Service, its software, design, text and the Bloomize name and logo belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use the Service during your subscription for your internal business purposes. You may share reports generated for your business and, on the agency plan, with your clients. If you send us feedback or ideas, we may use them without obligation to you.
Bloomize may offer optional expert help, such as local SEO or review management, provided by Los Angeles SEO Inc. Expert help is never required to use Bloomize. Any such service is quoted separately and governed by the separate agreement or proposal you accept for it.
We work to keep the Service available and secure, but it may sometimes be unavailable for maintenance, updates or reasons outside our control, and data from third parties may be delayed. Support is available by email at [email protected], usually within one business day.
We may suspend or close an account that breaks these Terms, creates a security or legal risk, or has unpaid charges, and we will tell you why unless the law or a security reason prevents it. You may close your account at any time. After your account closes, we delete or anonymize your Customer Data as described in the Privacy Policy; you can ask us for an export before you close it.
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service or third-party data will be uninterrupted, error-free or complete.
To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if advised of the possibility. Our total liability for all claims relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. These limits do not apply where the law does not allow them to be limited, including for fraud or willful misconduct.
If you use the Service for a business, you agree to defend and indemnify us against third-party claims arising from your Customer Data, your connection of accounts you were not authorized to connect, your clients’ claims against you, or your breach of these Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Before filing a claim, please email [email protected] so we can try to resolve it informally within 30 days. Any dispute that is not resolved will be heard in the state or federal courts located in Los Angeles County, California, and both parties consent to their jurisdiction. Either party may bring a qualifying claim in small claims court. Nothing in these Terms limits rights you have as a consumer that cannot be waived.
We may update these Terms. If a change is material, we will notify you by email or in the app at least 30 days before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms. If you do not agree, you can cancel before then.
These Terms are the entire agreement between you and us about the Service and replace earlier agreements on the same subject. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of the business, with notice to you. Notices to you may be sent to your account email.
